O R D E R

This is a joint application filed by the parties under Order 23 Rule 3 read with Section 151 of Code of Civil Procedure, 1908 with the following prayers:

"c) Record the present terms of compromise as being lawful;

d) Dispose of the present suit in terms of the terms and conditions as contained in paragraphs 2 and 3 of the present compromise application And pass any further orders that it may deem fit in the facts and circumstances of the present proceedings."

The application is signed by the authorized signatory of the plaintiff and by defendant no.1 on his behalf and as authorized signatory of defendant no. 2 and their counsels. The application is accompanied by the affidavit of authorized signatory of the plaintiff, defendant no.1 on his behalf and as authorised signatory of defendant no.2.

The parties have settled their inter-se disputes in terms of Paras 2 and 3 of the application. Learned counsel for the parties state that the settlement is lawful.

In terms of clause 2(g) of the application, the learned counsel for defendant has handed over a draft of Rs.1 lakh (INR 1,00,000/-) bearing no. 041527 dated 26th April, 2016 drawn on HDFC Bank in favour of "Anand and Anand" the counsel for the plaintiff.

Learned counsel for the plaintiff states that the draft being in the name of "Anand and Anand", the amount of Rs.1 lakh (INR 1,00,000/-) shall be remitted to the plaintiff "Honeywell International Inc." under the requisite laws and regulations after obtaining permission from the appropriate authorities. The learned counsel for the defendant has no objection in that regard. It is ordered accordingly.

The application and Suit stand disposed of in terms of Paras 2 and 3 of the application.

The date already fixed, i.e., 8th August, 2016 stands cancelled. I.A. 22084/2015 Dismissed as infructuous.
