After some argument, it is pointed out by the learned counsel for the petitioner that the trial is at advanced stage. The evidence by way of affidavit of the petitioner has already been filed and the trial is likely to be concluded by the trial court.

It was put to learned counsel for the petitioner that no purpose is served by pressing the present petition by which an order dated 08.09.2015 dismissing the application under Order 12 Rule 6 CPC filed by the petitioner is challenged in these circumstances.

The learned counsel for the petitioner submits that he would like to withdraw the present petition with a request that this court may give appropriate directions to the trial court to expeditiously record the evidence of the parties.

The petition is accordingly dismissed as withdrawn. The trial court is CM(M) 1116/2015

requested to expeditiously record the evidence of the parties and conclude the trial preferably within six months. Except in the emergent circumstances, none of the parties may be granted any adjournment in the matter. JAYANT NATH, J.
