The petitioner, claiming to be an occupant of the first floor of the DDA Community Centre at plot No.11, Okhla Phase-I, New Delhi, has filed this petition aggrieved from the rejection by the respondent no.1 BSES Rajdhani Power Ltd. (BSESRPL) of his request for electricity connection and seeking mandamus for being granted the connection. 2.
Notice of the petition was issued and on oral request of the counsel for the petitioner, the landlord viz. Mr. Kamaljeet Singh Ahluwalia was ordered to be impleaded as respondent no.3 and the petitioner directed to serve the respondent no.3 / landlord.

No steps have been taken by the petitioner for service of the respondent no.3 / landlord but the counsel for the petitioner states that he has filed his vakalatnama for the respondent no.3 / landlord as well. W.P.(C) 9955/2015

The counsel for the respondent no.1 BSESRPL states that the request of the petitioner for electricity connection was rejected because the area has not been electrified as yet but since under order of this Court, connections have been granted to some other occupants, the petition be disposed of on the same terms. Attention in this regard is invited to the order dated 7th March, 2014 of this Court in W.P.(C) No.3638/2011 titled Basant Project Ltd. Vs. BSES Rajdhani Power Ltd. and other connected petitions. 5.
The petition is accordingly disposed of with the directions that till the respondent no.1 BSESRPL electrifies the area in question and sets up its sub-station, temporary electricity connection at the tariff of permanent connection be granted to the petitioner in accordance with law subject to petitioner paying the requisite charges therefor and completing the other commercial formalities; after the electrification of the area is undertaken, the petitioner would be intimated thereof and if takes the steps for obtaining permanent electricity connection, permanent electricity connection shall be sanctioned again in accordance with law and subject to completion of the commercial formalities;
else the temporary connection shall be disconnected.
No costs.
