% 23.08.2019 Vide the present application, the petitioner seeks anticipatory bail in the event of his arrest in FIR No.220/2018 registered at PS Safdarjung Enclave for the offence punishable under section 420 IPC. Learned counsel appearing on behalf of the petitioner submits that based on the action initiated by the police on the complaint made by the complainant, the owner of the property bearing no.60/9, Yusuf Sarai Market was interrogated, who disclosed that the said premises was tenanted to the petitioner wherefrom Aman Shah Baba was operating his Trantrik services. Learned counsel further submits that the petitioner has no malicious intentions directly or indirectly for alleged offence but the police on the basis of previous tenancy agreement wants to implicate the petitioner.

On the other hand, learned APP for the State submits that the petitioner is the main accused who cheated the complainant for an amount of ₹2,50,000/- and the document and money to be recovered from the petitioner, therefore, he should not be released at this stage. Keeping in view the allegations against the petitioner, I am not inclined to release the petitioner on bail.
