O R D E R

% 14.03.2016 After small hearing, learned counsel for both the parties submit that they have taken consent from their respective clients and the present petitions may be disposed of accordingly. With the consent of the parties, both the petitions are disposed of, with the following directions:-

(i) Justice Kailash Gambhir, Retired Judge of this Court, Mob. No.9871300033) is appointed as sole Arbitrator to adjudicate the disputes arising out of the agreement in question between the parties as mentioned in the present petition. The parties are also allowed to file their respective claims and counter-claims before the Arbitrator.

(ii) The Arbitrator shall ensure the compliance of the provisions of Arbitration and Conciliation (Amendment) Act, 2015 before commencing the arbitration.

(iii) The interim order as already granted on 4th February, 2016 in O.M.P. (I) No.608/2015 shall continue till the time it is vacated or modified by the Arbitrator.

The respondent would be entitled to file an application under Section 17 of the Arbitration and Conciliation Act, for vacation/ modification of the interim order.

Copy of this order be given dasti to the learned counsel for the parties and a copy thereof be communicated to the learned Arbitrator forthwith. MANMOHAN SINGH, J.
