1. Pursuant to the previous order dated 18th January, 2016 an affidavit of compliance has been filed by the Senior Intelligence Officer, Directorate of Revenue Intelligence (DRI), Jaipur Regional Unit (JRU) dated 20th January, 2016. It is stated therein that out of the goods detained under detention memos and panchnamas dated 5th October 2016 and 6th November 2015, all other than the goods seized either as mentioned in the office letters dated 27th January 2016 or 24th November 2015, stand released. Learned counsel for the Petitioner states that he has no further grievance as far as the seized goods lying at the factory premises of the Petitioner at Bhiwadi are concerned.
2. However, learned counsel for the Petitioner raised a grievance that the consignment covered under three bills of entry which were seized at ICD Loni, Ghaziabad have not yet been released. In relation to these three bills of entry it is stated by Shri Bhawani Singh Shekavat, Senior Intelligence Officer, DRI, JRU who is present in Court that the JRU of the DRI has conveyed its no objection for provisional release thereof to the Petitioner to the Delhi Zonal Unit (DZU). He is, however, unable to state whether the DZU has in turn communicated this to the Commissioner (Customs) at Loni. A copy of the NOC furnished by the DRI, JRU to the DZU be furnished to the learned counsel for the Petitioner within three days.
3. No further directions are called for in this writ petition. The Petitioner is at liberty to raise all other issues, including those urged in this petition, in the adjudicating proceedings that might ensue.
