By virtue of the present application under Order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure, 1908 (CPC), the plaintiff is seeking consent decree in terms of the Settlement Agreement dated 20.03.2025.

At the outset, learned counsel for the plaintiff and the defendant no.1 submit that since the disputes inter se the plaintiff and the defendant no.1 herein have since been settled, the terms thereof have been reduced to writing in the form of the Settlement Agreement dated 20.03.2025, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
which is forming part of the record.

Learned counsel for the plaintiff also submits that in view of the aforesaid Settlement Agreement dated 20.03.2025, the plaintiff does not wish to press for any other relief(s) qua defendant no.1. 4.
Learned counsel of the plaintiff and the defendant no.1 confirm the terms of the Settlement Agreement dated 20.03.2025 and identify the signatures of their respective clients and pray that the suit be decreed in terms of the Settlement Agreement dated 20.03.2025. 5.
This Court has perused the terms of Settlement Agreement dated 20.03.2025 as recorded inter se the plaintiff and the defendant no.1 and finds them to be lawful.

Accordingly, the present application is allowed and disposed of. CS(COMM) 1287/2018, I.A. 17100/2018-Stay, I.A. 2661/2019-O 39 R 4 by D-3, I.A. 4926/2019-O 39 R 4 by D-2, I.A. 11270/2019-O 6 R 17 for amendment in the plaint 7.
Since no specific relief(s) have been sought against the defendant nos.2 and 3 herein, in view of the Settlement Agreement dated 20.03.2025 arrived inter-se the plaintiff and defendant no.1, learned counsel for the plaintiff does not seek to press any relief(s) against the remaining defendant nos.2 and 3.

Accordingly, the present suit is decreed in terms of the Settlement Agreement dated 20.03.2025 qua defendant no.1. 9.
Needless to mention, the plaintiff and the defendant no.1 shall remain bound by the terms of settlement as recorded in the Settlement Agreement dated 20.03.2025.

Decree sheet be drawn up accordingly.

Needless to mention, the Settlement Agreement dated 25.03.2025, shall form part of the Decree Sheet.
