The petitioner is seeking appointment of an Arbitrator under Section 11 of the Arbitration & Conciliation Act. There is a valid arbitration agreement between the parties contained in clause No. 10 (a) of the Transport Agreement dated 15th September, 2011. The disputes have arisen between the parties whereupon the petitioner invoked the arbitration vide notice dated 22nd May, 2015 which was replied to by the respondent on 01st June, 2015. 2.

The petition is allowed and Mr. Dipak K. Nag, Advocate, Mobile No.9891229500 is appointed as a sole arbitrator to adjudicate the disputes between the parties including their claims and counter-claims. 3.

The arbitration shall take place under the aegis of Delhi International Arbitration Centre ('DAC').

The Delhi International Arbitration Centre shall ensure the compliance of the provisions of the Arbitration and Conciliation (Amendment) Act, 2015 before commencing the arbitration.

Copy of this order be given dasti to counsel for the parties under the signature of the Court Master. A copy of this order be sent to the learned Arbitrator as well as Coordinator, DAC.
