% 08.08.2016 The petitioner has filed the above said petition. Counsel for the respondents states that the machinery i.e. Everest Mix Plant has been removed by the petitioner.
The same is not in the possession of the respondents. On the other hand, learned counsel for the petitioner states that the statement made by the learned counsel for the respondents is incorrect. Actually, the respondents had sold the machinery to the third party and the petitioner would be able to locate the same.
Liberty is granted to the petitioner to locate the machinery within the period of eight weeks from today.
Mr.Ankit Singh Rathor, Collect Manager, is appointed as the Receiver to seize the machinery and dispose of the same within three months from today and proceed of the same shall be adjusted towards the loan amount.
The present petition is accordingly disposed of. The receiver shall be at liberty to take the assistance of the local police, if required, for taking over possession of the machinery. The concerned SHO shall provide assistance to the receiver as and when requested.
