% 23.02.2016 The learned counsel for the parties inform me that a settlement has been reached in the matter. The learned counsel for the petitioner specifically affirms this position.

The learned counsel for the petitioner further states that he has instructions to withdraw the petition in view of the settlement arrived at with the respondent subject to the liberty being given by this court to revive the petition, in case, the settlement reached with the respondent, is breached.

The captioned petition is, accordingly, dismissed as withdrawn in view of the settlement arrived at between the parties. Liberty is, however, given to the petitioner to revive the captioned petition in case the respondent breaches the terms of the settlement. RAJIV SHAKDHER, J FEBRUARY 23, 2016/yg
