O R D E R

RFA 743/2015 & CM APPL.199/2018 This is an application under Order XXIII Rule 3 read with Section 151 of CPC seeking to place on record the settlement arrived at between the th July, 2017. The said application is accompanied with a parties dated 20 copy of the settlement deed which is in Hindi. Translated copy of the settlement deed has also been filed. The application is accompanied by the affidavits of the Appellant and the Respondent. They are both present in Court. They have been identified by their respective counsels. Both the parties submit that the disputes have been settled as per the terms of the settlement deed.

The Court has perused the settlement deed and there appears to be no impediment in recording the same. The terms are lawful. In view thereof, the

impugned judgment/decree is modified in terms of the settlement. The parties shall be bound by the terms of the settlement. All disputes between the parties stand settled. The appeal stands disposed of. Since the disputes have been settled, the Court directs refund of 50 % of court fee to the Appellant.

In view of the above, the appeal and all pending applications stand disposed of.
