% 03.08.2016 After some hearing, learned counsel for the appellant sought liberty to withdraw the appeal.

We are informed that the pending petition under Section 13 is listed on 30.08.2016 before the Family Court. The Family court shall first proceed to satisfy itself whether the amounts of maintenance directed have been paid to the respondent wife and thereafter proceed with the main matter. It shall pass such orders as may be necessary in that regard.

The appeal is dismissed as withdrawn but with the above directions.
