% 27.04.2017 The parties have amicably settled the matter through mediation and the terms of the settlement which recorded in the settlement agreement dated 25th April, 2017.

The appellants have paid Rs.13 lakh in cash to the respondents in terms of the settlement agreement dated 25th April, 2017. This appeal is disposed of in terms of the settlement between the parties.

Learned counsel for the appellant seeks refund of Court-fees. Since the appeal has been disposed of before the commencement of hearing, half of the fees be refunded to the appellant in terms of Section 16A(iii) of the Court-fees Act, 1870.
