% 18.02.2016 Counsel for the petitioner informs this Court that pleadings in the application under Order XXXIX R.4 of the CPC are complete but on one pretext or the other, at the request of the respondent/plaintiff, in the Trial court, the matter is getting adjourned. He has brought to the notice of this Court certain list of dates. His further submission is that ex parte order dated 27.3.2015 is operating against him which is prejudicial to his interest.
Be that as it may, in view of the submissions made by the learned counsel for the petitioner and his additional submission that the matter is listed before Trial Court for 22.02.2016, the Trial Court shall endeavour to dispose of the aforenoted application expeditiously.
With these directions petition disposed of.
