O R D E R

% 08.01.2019 By this petition the petitioner seeks parole on the ground that he has a history of ulcerative colitis which appears to have been transgressed to colon cancer.

On 20th December, 2018 this Court has directed Superintendent, Central Jail No.14, Mandoli to send the latest detailed medical report of the petitioner after getting him medically examined at G.B. Pant Hospital before the next date of hearing.

The medical report dated 4th January, 2019 by the Senior Medical Officer, Central Jail No.14, Mandoli has been handed-over by learned Standing Counsel for the State which shows that after the order dated 20th December, 2018 the petitioner was taken to G.B. Pant Hospital only on 2nd January, 2019. The petitioner was suggested certain tests including CECT abdomen, CT enterography and mauntaux test which are still to be done. W.P.(CRL) 3797/2018

However, the report notes that the petitioner is suffering from acute severe colitis and thus even his full length colonoscopy could not be done. Considering that petitioner needs immediate medical attention, this Court deems it fit to grant parole to the petitioner irrespective of the fact that the petitioner has surrendered in August, 2018. Consequently, the petitioner is directed to be released on parole for a period of four weeks on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount to the satisfaction of the Superintendent Mandoli Jail. Petition is disposed of. Order dasti.
