% 12.12.2017 CM APPL. APPL. 23707/2017 (direction) Instant contempt petition came to be filed alleging violation of the order dated 9.4.2015 passed by the ld. Single Judge in WP(C) 685/2011 Ankit Kumar Aggarwal & Ors. Vs. Airport Authority of India & Anr. Directions given there-under are, as follows : "12.
In view of the above, the present writ petition is allowed. The respondent no.1 is directed to give the necessary appointment letters to the petitioners for the posts of Manager (Electronics) within a period of four weeks from today. Parties are left to bear their own costs."
Ld. counsel for the petitioner concedes that in terms of the above-said directions, appointment letters have come to be issued. Today, before Court Mr.Rai, ld. counsel for the respondent has
handed over copies of the orders of pay fixation and seniority also to the ld. counsel for the petitioner.
On this, ld. counsel for the petitioner submits that the said pay fixation and seniority is not as per the own rules of AAI. If, that is so, the petitioner may have the lawful recourse to challenge that.
Suffice to say, instant proceedings are only proceedings on the allegations of violation of directions given by the ld. Single Judge on 9.4.2015, which was only to the effect of issuance of appointment letters. Since the appointment letters stand already issued, nothing further survives in the instant contempt petition and the same is disposed off accordingly, reserving the right to the petitioner to assail the issue of pay fixation and seniority, if, they so advised in accordance with law.
Application stands disposed off accordingly.
