Learned counsel for the respondent states, on instructions, that the Bank has published an auction notice today, in terms of the order dated 24.02.2016, passed in the present proceedings in respect of the mortgaged premises with a reserve price fixed as Rs. 34 crores, with the date for auction as 12.10.2017.

Mr. Bhandari, learned counsel for the petitioner states on instructions that his clients have not received a copy of the said auction notice. He further states that in view of the submission made above, he may be permitted to withdraw the present petition while reserving the right of the petitioners to W.P.(C) 10106/2015

seek legal recourse in respect of the sale of the property proposed to be conducted by the respondent/Bank. He, however, does not dispute the reserve price that has been fixed by the respondent No. 1/Bank in respect of the property.

Liberty as prayed for is granted. The petition is dismissed as withdrawn.
