$~47 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 13669/2018 SUPRIYA MAROTHI ..... Petitioner Through:
Mr Santosh Kumar Suman, Advocate.
versus PRESIDENTIAL SECRETARIAT AND ORS.
..... Respondents Through:
Mr Rakesh Kumar, CGSC for R-1 and R-2.
CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 22.02.2019 1.
The petitioner has filed the present petition, inter alia, praying as under:- "(a) Issue an appropriate writ, order or direction in the nature of mandamus directing the respondents to permit the mother, sisters and near and dear relations of the petitioner to enter into the Quarter No. 46, Type-II, Schedule-B, Narmada Apartments, Presidential Secretariat, New Delhi, to meet the petitioner with the consent of the petitioner, in the interest of justice."
2.
The petitioner states that she is residing in quarter no.46, Type-II, Schedule-B, Narmada Apartments, Presidential Secretariat, New Delhi and is aggrieved by the action of the respondents in not issuing security passes to her mother and her sister. The learned counsel appearing for the respondents states that the said accommodation was provided to respondent
no.3, and the same has since been cancelled in terms of an Office Memorandum dated 25.01.2019. According to respondent no.1, neither the petitioner nor the respondent no.3 are now entitled to occupy the quarter in question, therefore, the question of issuing any security pass to the petitioner's mother or her sister does not arise. 3.
It is apparent that there are matrimonial disputes between the petitioner and the respondent no.3. It is open for the petitioner to seek any relief against the respondent no.3 including seeking reasonable amount for securing alternative accommodation and maintenance. However, no relief can be sought against the respondent no.1. The allotment of the flat in question having been cancelled, the prayers as sought for by the petitioner cannot be granted.
4.
The petition is, accordingly, dismissed.
