O R D E R

% 22.03.2016 The petitioner has filed the present petition under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator. Reply has not been filed. On the last date, adjournment was sought by the learned counsel for the respondent for taking instructions from his client.

Counsel, upon instructions, states that the respondent has no objection if a sole Arbitrator is appointed by this Court to adjudicate the disputes between the parties.

With the consent of the parties, the prayer made in the petition is allowed. Hon'ble Mr. Justice M.K.Sharma, Retired Judge of the Supreme Court of India (Mob. No.9818000190) is appointed as sole Arbitrator to adjudicate the disputes between the parties as mentioned in the present petition.

The parties are also allowed to file their respective claims and

counter-claims before the Arbitrator. Liberty is granted to the respondent to raise all the objections as per the terms and conditions of the agreement. The Arbitrator shall ensure the compliance of the provisions of Arbitration and Conciliation (Amendment) Act, 2015 before commencing the arbitration.

The petition is accordingly disposed of.

Copy of this order be given dasti to the learned counsel for the parties and a copy thereof be communicated to the learned sole Arbitrator forthwith. MANMOHAN SINGH, J.
