% 08.02.2019 On 25.09.2018, this court had admitted the petition and had given time to the respondent to pay the stated amount of Rs.63,43,965/- within four weeks and in that eventuality the order appointing the Official Liquidator as the Provisional Liquidator would stand revoked. Against the said order dated 25.09.2018, the respondent preferred an appeal before the Division Bench being Co. Appeal 31/2018 which was dismissed on 21.12.2018.

I may note that in a connected matter, namely, Co. Pet. 861/2015, I have also admitted the petition and appointed the Official Liquidator as the Provisional Liquidator against the respondent Company. In view of the order appointing the Official Liquidator as the Provisional Liquidator, nothing further survives in the present petition. Petition stands disposed of. Liberty is granted to the petitioner to file its claim before the Official Liquidator in the prescribed format within eight weeks from today.
