O R D E R

% 25.07.2016 After some arguments, learned counsel for the respondent submits that without prejudice, let a sole Arbitrator be appointed by this Court. However, both the objections raised by the respondent pertaining to the limitation and not following the procedure as per Clause 16 of the Agreement be kept open.

Learned counsel for the petitioner has no objection in this regard. Accordingly, Justice R.V.Easwar, retired Judge of this Court (Mobile No.9560899997) is appointed as sole Arbitrator to adjudicate the disputes between the parties as mentioned in the present petition.

The parties are also allowed to file their respective claims and counter-claims before the Arbitrator. In addition to that, the respondent is also allowed to raise the abovementioned two grounds before the Arbitrator.

The Arbitrator shall ensure the compliance of the provisions of Arbitration and Conciliation (Amendment) Act, 2015 before commencing the arbitration. The fees of the learned Arbitrator shall be in terms of the schedule of the amended Act. The parties to appear before the Arbitrator on 11th August, 2016 at 4.00 p.m. for directions. The petition is accordingly disposed of.

Copy of this order be given dasti to the learned counsel for the parties and a copy thereof be delivered to the learned Arbitrator forthwith. MANMOHAN SINGH, J.
