O R D E R

Mr. Ravi Sikri, the learned senior counsel appearing on behalf of the respondents, on instructions, submits that the respondents are ready to implement the IRAS pattern of promotion for the technical staff within a period of four months.

He submits that it goes without saying that once the technical staff has availed the IRAS pattern, they will not be entitled to the benefits under MBAPS which has already been implemented in place of IRAS. 3.

On the other hand Mr. M.C. Dhingra, the learned senior counsel appearing on behalf of the petitioner submits that MBAPS has not been approved by the Ministry of Finance, as well as, the concerned Ministry i.e. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the Ministry of Health and Family Welfare, which position is controverted by Mr. Sikri.

Be that as it may, let IRAS pattern of promotion be implemented qua such employees of the technical staff, whose affidavits have been placed on record.

Mr. M.C. Dhingra, on instructions from the Secretary namely, Mr. Rohitash Singh, who is present in Court, states that the employees are ready to face any consequences which may arise as a result of the implementation of IRAS. The statement is taken on record.

In view of the above, the petition stands disposed of. 7.

Let compliance affidavit be filed by the respondents within four months from today.
