The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.1062/2015 registered under Section 376 IPC and 4 POCSO Act at PS Govindpuri. Status report is on record. 2.

I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 11.08.2015. Status report reveals that upon completion of investigation, a chargesheet has already been filed in the Court. It further reveals that the petitioner and the prosecutrix were acquainted with each other for the last about 5 - 6 years. They had decided to marry. It is informed that roka ceremony took place on 13.04.2015 and ring ceremony on 07.02.2015.

Allegedly, on 15.03.2015 physical relations were established without her consent. She was around 17 years on the day of occurrence. No visible injuries were found on her body at the time of her medical examination.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 50,000/- with one surety in the like amount to the satisfaction of the Trial Court.
