M/S K R Anand v. Delhi Development Authurity
$~12 * IN THE HIGH COURT OF DELHI AT NEW DELHI + O.M.P.(MISC.)(COMM.) 405/2018 M/S K R ANAND ..... Petitioner Through Mr. Bharat Bhushan Bhatia, Adv.
versus DELHI DEVELOPMENT AUTHURITY ..... Respondent Through Ms. Gaini Chaturvedi, Mr. Rajeev Jha and Ms. Meenakshi Sharma, Advs.
CORAM:
HON'BLE MR. JUSTICE RAJIV SHAKDHER
O R D E R
% 21.12.2018 I.A. No.17792/2018 Allowed, subject to just exceptions.
O.M.P.(MISC.)(COMM.) 405/2018 Ms. Gaini Chaturvedi accepts notice on behalf of the respondent. Learned counsel says that she does not wish to file a reply as the respondent does not oppose the prayer for extension of time to enable conclusion of the arbitration proceedings. The record shows that the Supreme Court had constituted the Arbitral Tribunal vide order dated 12.04.2017. On being queried as to whether extension was granted by another six months, albeit, by mutual consent, beyond the statutory period of 12 months, learned counsel for the parties were not able to give a satisfactory response.
O.M.P.(MISC.)(COMM.) 405/2018
What I have on record is the order of the Arbitral Tribunal dated 06.12.2018, which is indicative of the fact that the time for pronouncing the Award is expiring 'in and about 06.01.2019'. I am informed that the matter is at the stage of evidence. Having regard to the time and money invested by the parties, I am inclined to extend the period by another two months, as prayed for, commencing from 06.01.2019.
Petition is disposed of in the aforesaid terms. RAJIV SHAKDHER, J DECEMBER 21, 2018 O.M.P.(MISC.)(COMM.) 405/2018
