By this petition, the petitioner had challenged the summons issued to the petitioner by the respondent while investigating ECIR/292/DLZOII/2009(PK)/2942 on an FIR registered by the CBI being RC No.0712009(E)0003/2009 under Sections 120B/420/467/468/471/511 IPC read with Section 13(2) and 13(1)(d) of the Prevention of Corruption Act. 2.
Learned counsel for the respondent states that while investigating the offence under Section 3/4 of the Prevention of Money Laundering Act (PMLA), summons were issued to the petitioner which have been challenged in the present petition and after the investigation, complaint has already been filed before the Court of competent jurisdiction. Hence the present petition has become infructuous.

In view of the statement of learned counsel for the respondent, learned counsel for the petitioner seeks leave to withdraw the present petition and the application to take remedies as available in law in case summoned by the learned Trial Court.
