% 30.10.2015 We have heard the learned counsel for the parties. It appears that the appeal in respect of the assessment year 2012-13 is pending before the Commissioner of Income Tax (Appeals). The present writ petition pertains to the penalty proceedings. We are of the view that the Commissioner of Income Tax (Appeals) should dispose of the appeal expeditiously and preferably within two months in accordance with law. Till such time the appeal is disposed of, the respondent shall not recover the penalty amount.

The writ petition stands disposed of.
