After some arguments, learned counsel for the parties on instructions submit that both the parties want to settle the matter and respondent has agreed to give time to the petitioner till 11th February, 2018 to vacate the suit property.

Learned counsel for the petitioner has filed the undertaking of the petitioner to the above effect.

Learned counsel for the parties submit that in view of the settlement entered into between the parties whereby the petitioner has agreed to vacate the suit property by 11th February, 2018 and also to clear the dues of rent and electricity, if any, payable by that date, this petition may be disposed of in terms of the settlement agreement between the parties. 3.
Learned counsel for the petitioner submits that as the matter has been settled between the parties, this petition may be disposed of in terms of settlement.

In view of the settlement between the parties conditions of which are incorporated in the undertaking furnished by the petitioner, the petition is disposed of in terms of settlement. Petitioner shall be bound by the terms of undertaking furnished today in the Court.
