Bail Appln.2392/2015 The petitioners seek bail in anticipation of their arrest in connection with FIR No.1899/2015 (PS Shakarpur) instituted for offences under Sections 186/353/332/34 of the IPC.

On the day of the occurrence, a vehicle was wrongly parked in a public area creating traffic bottlenecks. When a Constable on traffic duty asked the inmates of the vehicle to remove the vehicle from the public area, the vehicle was removed but the Constable was assaulted and his uniform was torn. This led to the registration of FIR No.562/2015 for offences under sections 186/353/332/506/34 of the IPC.

The vehicle was found to be registered in the name of petitioner no.1. It was in that connection that the house of the petitioner was visited. It is alleged in the present FIR that the police personnel who went to the house of petitioner no.1, were ill-treated, misbehaved with and assaulted and some of the police personnel were injured. This led to the registration of the subject FIR in which the petitioner is seeking bail.

Considering the fact that in the first instance, the petitioner was not available in the car as only students of DPS school were present and the fact that the petitioner has joined the investigation, this Court is inclined to confirm the provisional anticipatory bail to the petitioners. For the aforesaid facts, let the petitioners be released on bail, in the event of their arrest, on their furnishing a bond in the sum of Rs.20,000/- each with one surety of the like amount to the satisfaction of the arresting officer.

The application is allowed and disposed of accordingly. Dasti.
