% 06.09.2017 Learned counsel for the parties submit that settlement has been arrived at between the parties vide an agreement dated 31.08.2017 and that the respondent company shall pay to the petitioner as per the terms and conditions set out in the said agreement and shall be bound by the same. The agreement entered into between the parties be filed within three days from today. The first instalment though was payable on 31.08.2017 with a grace period of 10 days, has not been paid till today. The counsel for the respondent undertakes that it shall be paid on or before 10.09.2017. The learned counsel for the petitioner hence withdraws the petition with liberty to revive it if the payments are not forthcoming as per schedule given in the agreement. The agreement dated 31.07.2017 shall be a part of this order and an affidavit of undertaking be also filed by the Managing Director of the

respondent company in accordance of terms and conditions of the agreement, within two weeks from today.
