% 21.12.2018 After some hearing, the counsel for the petitioners seeks permission to withdraw the petition submitting that the petitioners may be given liberty to approach the criminal court with an application under Section 311 Cr.P.C. seeking recall of the witness CW-1 for further cross-examination explaining the reasons why the counsel for the petitioners could not cross-examine the said witness on the two dates when the witness was present i.e. 04.05.2018 and 07.12.2018.

The petition is dismissed as withdrawn with liberty to move the application, as mentioned above.

This court hopes and trusts, the criminal court will bear in mind the circumstances, as mentioned above, while considering the aforesaid application.
