After arguments this appeal is allowed with the consent order that the impugned order dated 2.9.2015 is set aside and the legal heirs of the defendant are brought on record.

Amended memo of parties has already been filed before the trial court and the same is taken on record. Appeal is however allowed subject to payment of costs of Rs.15,000/- to the respondent and which costs shall be paid positively within four weeks from today.

Parties to appear before District & Sessions Judge (Central), Tis Hazari Courts, Delhi on 30th November, 2017 and the District & Sessions FAO No.394/2015

Judge will mark the suit for disposal to a competent court in accordance with law.
