% 14.03.2016 The present application has been filed by the petitioner/ complainant under Section 439(2) Cr.P.C. read with Section 482 Cr.P.C. for cancellation of anticipatory bail granted to the respondent no.1-Ashish Pandit by the learned Additional Sessions Judge vide order dated 01.05.2015 in FIR No.175/2012, under Sections 406/409/ 420/468/471/120-B IPC, Police Station Economic Offences Wing. During the course of arguments, it has been submitted by the learned Additional Public Prosecutor for the State that the charge sheet in the present matter has already been filed.

Since it has come on record that the charge sheet has already been filed, apparently the respondent no.1 is not required for the purpose of investigation or arrest by the police authorities. Before parting with the order, this Court is of the considered view that it is for the Trial Court to consider the regular bail of the respondent No.1 under Section 437 Cr.P.C. after the filing of the charge sheet.
