O R D E R

% 18.03.2019 By this petition the petitioner seeks anticipatory bail in case FIR No. 167/2014 under Section 420 IPC registered at PS Barakhamba Road on the complaint of Satish Luthra.

The above-noted FIR was registered pursuant to directions under Section 156(3) Cr.P.C. The allegations of the complainant are that Jagjeet Sehdev who was a distant relative introduced him with Rajpal Singh and his wife. Rajpal Singh represented himself to be Chairperson of a political party of Himachal Pradesh and he used to call the complainant. Later on Rajpal Singh assured that he would get jobs for his children as the complainant was seeking job for his daughter and his son as District Attorney and DSP (Punjab) respectively. demanded ₹50 lakhs and the complainant paid to them ₹5 lakhs and a further instalment of ₹17 lakhs. However, no such job was provided. Additionally the accused used to also allure the complainant on the pretext that he could invest the money in the DDA Flats and would get safe returns on the same. A perusal of the FIR and the investigation reveals that the allegations were primarily against the husband of the petitioner and after death of the petitioner's husband the Police started joining the petitioner in investigation. Considering the fact that the main allegations are not against the petitioner but against her husband who has since passed away and the charge-sheet has been filed without arrest of the petitioner, this Court deems it fit to grant anticipatory bail the petitioner.

It is therefore directed that in the event of arrest the petitioner be released on bail on her furnishing a personal bond in the sum of `25,000/- with one surety bond of the like amount to the satisfaction of the Arresting Officer/ SHO concerned/ Court concerned, further subject to the condition that in case of change of residential address the petitioner will intimate the same to the Court concerned by way of an affidavit.

Petition is disposed of. Order dasti.
