versus UNION OF INDIA AND ANR.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 27.05.2019 CM APPL. 25870/2019 1.

This is an application filed by the petitioner seeking recall of the order dated 19.12.2018, whereby the petition was dismissed as withdrawn with liberty to the petitioner to make a representation. 2.

The petitioner had withdrawn the said petition as the notification dated 28.08.2018, impugned in the petition, had only placed the draft rules in public domain and invited comments and objections. This Court finds no grounds to recall the order. The application is dismissed. CM APPL. 25871/2019 3.

The petitioner has filed the present application in a disposed of

petition seeking that the respondents be directed to produce the entire records of the 81st Meeting of Drugs Technical Advisory Board (DTAB). According to the petitioner, the said minutes have been tampered with. The application is misconceived as the main petition itself is withdrawn. There is no question of passing any order for the production of any documents in a disposed of petition.

4.

It is, however, clarified that this order would not preclude the petitioner from instituting an appropriate action for availing substantive reliefs in accordance with law.
