Learned counsel for the petitioner submits that the respondent has already died and the petitioner has settled all disputes with the legal heirs of the respondent and they have paid the entire settlement amount vide DD No. 014383 dated 11.04.2017 for Rs.75,000/- before the court of Civil Judge-02 (South), Saket Courts, New Delhi on 18.04.2017, where the execution of the impugned award was pending. Along with the application, the petitioner has placed on record the copy of the statement made by the legal heirs of the respondent as also the copy of the order of the Civil Judge dated 18.04.2017 by which the execution was disposed of as withdrawn by the LR of the respondent.

The petitioner has challenged the impugned award dated 17.12.2005 and pursuant to the order dated 03.11.2015 of this Court, the petitioner has deposited a sum of Rs.1,15,341/- with the registry of this court.

Learned counsel for the petitioner submits that since the matter has been settled, he does not want to pursue the writ petition. In view of the same, the writ petition and pending application, being CM No. 25631/2015 are dismissed as withdrawn.

The amount deposited by the petitioner be released to him along with accrued interest. CM No. 8370/2018 is disposed of accordingly. VINOD GOEL, J.
