By way of this writ petition filed under Article 226 of the Constitution of India read with Section 482 of Cr.P.C., petitioner is praying for issuance of direction for cancellation of FIR No.182/15 under Section 420 IPC at PS Shahdara.

Status report on behalf of the State has already been filed. 3.

Learned A.S.C. for the State has also placed on record copy of the order dated 21st March, 2016 passed by learned Trial Court whereby the petitioner has been declared as proclaimed offender. It is also worth mentioning here that anticipatory bail was granted to the petitioner with certain conditions.

The petitioner has neither joined the investigation nor fulfilled the condition imposed on him.

Learned counsel for the petitioner has submitted that it is a case of civil dispute hence the FIR may be cancelled. 6.

Since investigation in the matter is in progress, at this stage FIR/Criminal prosecution cannot be quashed merely because as per the petitioner it is a case of civil dispute.

The writ petition is dismissed.
