% 08.02.2016 Impugned order suffers from no infirmity. Admittedly, no reply was filed to the application filed by the plaintiff seeking amendment of his plaint.

Learned counsel for the petitioner (defendant in the Trial Court) submits that the amendments would have been barred by limitation; she is however candid on the fact that she has not filed reply in writing to this effect. The question of limitation shall be kept open by the Trial Court and if necessary an issue on the said aspect shall be framed by the Trial Court.

Petition disposed of in the above terms.
