O R D E R

% 05.02.2019 Challenge in this appeal is to the order dated 10.12.2018 by which the Family Court has allowed the mother to keep the passport and PIO card of the child with her, post her return from a trip to Sri Lanka. After some hearing in the matter, it is agreed that since child is a US Citizen and permanent custody is with the mother, to balance the equities, the passport and PIO Card would be deposited with the Family Court, who will keep the same in safe custody. The passport will be released to either of the parents only upon orders to be passed by the appropriate court. Learned counsel for appellant has also pointed out that the name of the child has been changed from Jai Vij to Khush Ahuja. It is agreed that the change of name is likely to create some confusion. Accordingly, in case, the name is changed, the respondent would take appropriate measures for

completing necessary formalities towards change of name. The appellant present in court undertakes to cooperate with the respondent for the said purpose. Passport and PIO card will be deposited in the Family Court within one week from today.

In case, any of the parties wish to get the Passport and PIO Cards released for a specific purpose, appropriate application will be made before the Family Court who will pass appropriate directions in this regard. The appeal is disposed of.
