O R D E R

% 20.12.2018 Learned counsel for the petitioners states that a quarrel took place between the parties relating to the issue of parking of the vehicles. This incident took place on 15.10.2018 consequent to which FIR No. 349/2018 under Sections 356/379/452/354/354B/323/427/506/34 IPC was registered at police station Govind Puri on the complaint of respondent No. 2. A cross case being FIR no.350/2018 was also registered in respect of the incident. The concerned parties have now settled the matter vide compromise deed dated 11.12.2018. The cross case has already been quashed.

It is prayed that aforesaid FIR may also be quashed in view of the

settlement.

Respondent No. 2-Om Prakash is present in Court and has been identified by SI Deepak Panwar of police station Govind Puri. Respondent No. 2 states that he has settled the matter with petitioner of his own free will, voluntarily and without any undue force, pressure or coercion. He further submits that he is not willing to pursue the FIR any further and the same may be quashed.

Keeping in view the settlement arrived at between the petitioners and respondent no. 2 voluntarily. In my view, no fruitful purpose would be served in keeping the criminal proceedings pending. In the interest of justice, FIR No.

349/2018 under Sections 356/379/452/354/354B/323/427/506/34 IPC registered at police station Govind Puri, is quashed.

Petition is disposed of in the above terms. Miscellaneous applications also disposed of being infructuous.

Petitioner No. 5 Dinesh Thakur, who is in custody, shall be released from the jail forthwith in case not required in any other case. Dasti. A.K. PATHAK, J DECEMBER 20, 2018/mr
