% 06.02.2019 I.A. 1829/2019 Present application has been filed by the plaintiff under Order 23 Rule 1 CPC.

Learned counsel for plaintiff states that plaintiff and defendant have arrived at an amicable settlement of their disputes and have executed a Settlement Deed dated 25th January, 2019 wherein the defendant No.1 has agreed not to use the impugned VASORA packaging/trade dress or any other label/packaging/trade dress/element/sticker which may be deceptively similar to the plaintiff's V-GUARD label/carton/packaging/trade dress. Keeping in view the said fact, the present application is allowed and suit is disposed of as infructuous.

Registry is directed to issue to the plaintiff a certificate authorizing him to receive back from the Collector full amount of the Court fee paid by

it in the present suit.

The date of 06th March, 2019 is cancelled.
