The petitioner has filed the present petition, inter alia, praying that he be allowed to withdraw the liberty, which was sought for and granted to the petitioner by an order dated 29.03.2019.

The petitioner had moved the above captioned bail application (Bail Appl.3035/2018) on 29.03.2019. After some arguments, the petitioner had sought to withdraw the same with liberty to press the same after the victim and material witnesses were examined. The order dated 29.03.2019 does

not record any specific liberty. However, the bail application was dismissed as withdrawn.

The learned counsel appearing for the petitioner states that the statement made on 29.03.2019 now precludes the petitioner from filing any other bail application before the victim and the material witnesses are examined.

It is in this context he seeks to withdraw his statement. 6.

As noticed above, the petitioner was not granted any liberty by the order dated 29.03.2019. It is also noticed that the petitioner had withdrawn the above captioned petition after some arguments. Nonetheless, since the petitioner seeks to modify his statement, it is clarified that the petitioner would not be precluded from filing any bail application. Needless to state that if any such application is filed, the same would be considered keeping in view of the fact that the petitioner had withdrawn the earlier bail application after arguments.
