The present petition under Article 226 of the Constitution of India seeks the following prayers:

"i. Pass necessary orders and directions thereby quashing FIR no. 57 OF 2017, registered at Police Station Sarita Vihar, New Delhi, District - South East, Delhi, under Section 406 / 420 / 34 IPC and all the proceedings emanating therefrom.

ii. Pass necessary orders and directions thereby quashing the impugned order dated 18.02.2017 passed by the court of Ms. Gurmohina Kaur, Ld. MM - 02/SE/Saket Court/18.02.2017 in Comp. Case no. 634197/16 in case title Chetan Kapur &Anr. versus M/s Krrish Realty nirman Pvt. Ltd.;

may deem fit and necessary in the facts and circumstances of the case." 2.

Learned Additional Standing Counsel, on instructions of the Investigating Officer, SI Bhram Pal, submits that the closure report in the present FIR has been filed on 03.10.2020, which is pending before the Court of competent jurisdiction.

In view of the above, learned counsel appearing on behalf of the petitioners seeks leave to withdraw the present petition with liberty to initiate appropriate proceedings, in accordance with law, if so required. 4.

Leave and liberty granted.

The present petition is dismissed as withdrawn and disposed of accordingly.
