+ CRL.M.C. 6600/2018 SH. SATVINDER SINGH & ORS.
..... Petitioners Through:
Ms. Anita Diwedi, Adv.
versus STATE & ANR.
..... Respondents Through:
Mr. Raghuvinder Varma, APP for State with SI Deshpal, P.S. Gandhi Nagar.
Respondent no.2 in person.
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 10.01.2019 Respondent no. 2 (wife) is present in Court and has been identified by SI Deshpal of police station Gandhi Nagar. She submits that she has settled the matter with petitioner no.1 (husband) and his father, that is, petitioner no. 2 of her own free will and without any undue force, pressure or coercion. Presently, she has no grievance against the petitioners, therefore, she is not willing to pursue the FIR No. 191/2013 under Sections 498-A/406/34 IPC registered at police station Gandhi Nagar and the same may be quashed. Affidavit of respondent no.2 is also on record to this effect. Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be served to keep them entangled in criminal proceedings. Accordingly, in the
interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
