This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The brief facts of the case are that the petitioner sold property bearing Plot No.6, Khasra No.23/10, Ambey Garden, Libaspur, Delhi to the complainant on 15.6.1995 through a set of documents and her husband, Suraj Dev Prakash, signed the said documents as a witness. It is alleged that the said property was again sold by the petitioner to two different persons on 21.11.1999 and 5.1.2000.

Learned counsel for the petitioner submitted that the alleged cause arose in the year 1995, whereas the FIR was lodged in the year 2017.

The Investigating Officer ('IO') present in the Court has admitted the aforesaid position.

Taking into consideration the time-gap of approximately 23 years in lodging of the FIR, I deem it appropriate that this anticipatory bail application ought to be allowed. 6.

Accordingly, in the event of her arrest, the petitioner be released on bail, subject to her furnishing a personal bond in the sum of Rs.25,000/-, with one surety of the like amount to the satisfaction of the IO/SHO. It is directed that the petitioner shall join and cooperate in the investigation and is also directed not to do anything which may prejudice the investigation or influence the witnesses or the record in any manner. 7.

Accordingly, the anticipatory bail application is disposed of.
