CORAM:

HON'BLE MR. JUSTICE RAJIV SHAKDHER

O R D E R

% 07.01.2019 I.A. No. 28/2019 (Exemption) 1.

Allowed, subject to just exceptions.

O.M.P.(MISC.)(COMM.) 3/2019 2.

This is a joint petition filed under Section 29A(4) of the Arbitration and Conciliation Act, 1996 ( in short "1996 Act") for extension of time. 3.

Even though, this is a joint petition, the opposing side i.e. Oil & Natural Gas Corporation Ltd ("ONGC") is not represented by counsel. The petition has, however, been signed by the counsel for ONGC. 4.

Likewise, the petition is also been signed by counsel for the petitioner.

4.1 The affidavits of Authorised Representatives of both the sides are also appended to the petition.

4.2 Therefore, in my view, no notice needs to be issued to ONGC in the O.M.P.(MISC.)(COMM.) 3/2019

matter.

5.

The record shows that the Arbitral Tribunal entered upon reference on 05.06.2017.

6.

I am informed by counsel for the petitioner i.e. Planet Cast Technologies Limited ("PCTL") that arguments have been heard and the matter is reserved for pronouncement of the award. 7.

As a matter of fact, my attention has been drawn to the e-mail dated 21.11.2018 sent by the Presiding Arbitrator seeking extension of time till 31.01.2019.

8.

In view of the aforementioned e-mail of the Presiding Arbitrator, I am inclined to extend time for rendering the award till 31.01.2019. 9.

The petition is disposed of in the aforementioned terms. 10.

The Registry will dispatch a copy of the order to the ONGC at the address given in the Memo of Parties.

11.

Dasti under the signatures of Court Master.
