This application has been filed under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 praying for a decree to be passed in terms of the Settlement Agreement dated 24.07.2024, executed between the parties before the Delhi High Court Mediation and Conciliation Centre. The said Agreement is signed by the parties. 2.

The parties are present in person in the Court and have been duly identified by their respective counsels. remain bound by the same.

I have also perused the terms of the Settlement Agreement dated 24.07.2024, and find the same to be lawful. 4.

In view of the above, the Suit is decreed in terms of the Settlement Agreement dated 24.07.2024, binding the parties to the terms thereof.

The learned counsels for the parties submit that in terms of the Settlement Agreement, the suit property is to be sold, and the proceeds thereof are to be shared between the parties in the ratio prescribed in the Settlement Agreement. They submit that the parties have agreed that the property has to be sold within a period of six months from today.

Accordingly, the parties shall file their compliance affidavits once the terms of the Settlement Agreement are complied with by them. In case of any difficulty, it shall be open to the parties to take appropriate remedy in accordance with law.

The next date of hearing, that is, 21.08.2024, stands cancelled.
