% 27.02.2017 A communication has been received from the learned ASJ in terms of the order dated 26.10.2016. A perusal of the said communication dated 10.02.2017 shows that several accused persons, who are in custody, were not produced before the Court.

It is the obligation of the State to produce the accused, who are in custody, on the dates fixed before the Trial Court so that the recording of evidence is not hampered. The State is directed to ensure that the accused, who are in custody, are produced before the Court on the dates fixed before the Court. In case they are not produced for any specific reason, the reason should be placed before the Trial Court and the Trial Court should also examine the justification offered and record the same in the order.
