Counsel for the parties were heard at length. After arguments, it is agreed that this appeal be allowed and the impugned judgments of the courts below dated 21.5.2015 and 11.2.2014 are set aside with consent but setting aside of these judgments will not in any manner be a reflection on merits of the respective cases of the parties and all issues of facts and law including issues of facts and law as per the defences of the defendants/respondents will be decided in accordance with law at the stage of final arguments in the suit.

Appeal is therefore allowed and disposed of subject to aforesaid observations.
