This order is being passed in continuation of the order dated 1st February, 2016, on which date, learned counsel for the petitioner had stated that the petitioner had been wrongly declared unfit by the respondent No.3-Recruiting Officer, Coast Guard, for enrolment to the post of Navik in the Indian Coast Guard on the ground that he is suffering from CSOM (RT), i.e., chronic suppurative otitis media (RT) whereas he had produced a diagnosis from the Department of ENT, Safdarjung Hospital, New Delhi, declaring that he was found fit. To resolve the issue, with the consent of the parties, the petitioner was directed to appear before the Army R&R Hospital, Delhi for his medical check-up and the opinion from the Medical Board was directed to be submitted in a sealed cover for our perusal.

The Report has been handed over by learned counsel for the respondents in a sealed cover, which has been opened. As per the Report dated 16th January, 2016, the Medical Board has opined as below: - "A case of CSOM (Rt), healed with extensive scarring and thinning of ear drum, leading to hearing loss on (Rt) side over high frequency and low compliance. Do not meet the Medical Standard for Coast Guard. Unfit for Coast Guard." 3.

In view of the opinion of the Medical Board that the petitioner is suffering from hearing loss of the right side over high frequency and low compliance, which makes him unfit for the post of Navik in the Indian Coast Guard, the present petition is dismissed as not pressed. A copy of the Report has been handed over to learned counsel for the parties and the same is taken on record.
