% 16.08.2017 On 23rd November, 2016, learned counsel for defendant nos.1 to 4 had stated at bar that the matter had been amicably settled and that an appropriate application under Order XXIII CPC in this regard would be filed shortly. Accordingly, the matter was re-notified for 17th January, 2017.

Thereafter none appeared for the plaintiff on 17th January, 2017, 13th July, 2017 and 26th July, 2017.

Today learned counsel for defendant nos.1 to 4 states that he has been served with an advance copy of the application under Order XXIII Rule 1 CPC for withdrawal of the present suit. Since none is present for the plaintiff, the present suit is dismissed.
